We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

This agreement is in effect as of May 1, 2022.

Privacy

Your privacy is very important to us. We are bound to the Health Insurance Portability and Accountability Act (HIPAA), which is a separate form you must sign in order to obtain services at any of our offices. Our HIPAA policy is included under the scope of this User Agreement.

Personal Responsibility.

You agree that you will accurately represent the information you provide to us on or through this "Client Portal". You acknowledge that you are participating voluntarily in using our "Client Portal" and that you are solely and personally responsible for your choices, actions, and information provided.

No Guarantees.

Our role and services are to support and assist you in reaching your own goals, but your success depends primarily on your own effort, motivation, commitment, and follow-through. We cannot predict, nor do we guarantee that you will attain a particular result. You accept and understand that results differ for each person. Each person's results depends on their unique background, dedication, desire, motivation, actions, and numerous other factors. You fully agree there are no guarantees as to the specific outcome or results you can expect from using the information you receive on or through this "Client Portal".

Limitation of Liability.

By using this "Client Portal", you agree to hold harmless Sacred Wandering, its services, and clinicians of any liability or loss you may incur from using the "Client Portal".  You also agree that Sacred Wandering, its services, and clinicians will not be liable to you for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages, for use of or reliance on the "Client Portal".

Technology Disclaimer.

Sacred Wandering does not own the technology used for the "Client Portal". Therefore, we cannot guarantee that your access will not be suspended or restricted from time to time, including allowing for repairs, maintenance, or updates. To the fullest extent permitted by law, we will not be liable to you for damages or refunds, or for any other recourse, should our "Client Portal" or its Content become unavailable or access to them becomes slow or incomplete due to any reason, such as system back-up procedures, internet traffic volume, upgrades, overload of requests to the servers, general network failures or delays, or any other cause which may from time to time make our "Client Portal" or its Content inaccessible to you.

"Client Portal" Use and Consent

By accessing or using this "Client Portal" and its Content, you represent and warrant that you are at least 16 years old and that you agree to and will abide by this agreement. If you are under 18 years of age, you agree that you are using this site with the expressed permission of your Parent/Legal Guardian. Any registration by, use of, or access to the "Client Portal" and its Content by anyone under age 16, or without the expressed permission of your Parent/Legal Guardian if you are under 18 years of age, is unauthorized and in violation of this agreement.

Responsible Use

By visiting our "Client Portal" and accessing the information, resources, services, products, and/or tools provided, you agree to use this "Client Portal" only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations, and generally accepted online practices or guidelines.

Wherein, you understand that:

a. In order to access the "Client Portal", you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the "Client Portal". You agree that any information you provide will always be accurate, correct, and up to date.

b. You are responsible for maintaining the confidentiality of any login information associated with your account. Accordingly, you are responsible for all activities that occur under your account.

c. We may provide various communication tools on our "Client Portal". By using those communication tools, you agree that you will not upload, post, share, or otherwise distribute any content that:

i. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;

ii. Contains any type of unauthorized or unsolicited advertising;

iii. Impersonates any person or entity.

Sacred Wandering reserves the right, in consultation with other professionals, to report such activity as permitted by law.

Your Conduct

You are agreeing that you will not use our "Client Portal" or its Conduct in any way that causes or is likely to cause the "Client Portal", Content, or access to them to be interrupted, damaged or impaired in any way. You understand that you are solely responsible for all electronic communications and content sent from your computer to this "Client Portal" and its Content and to us.

You agree to be financially responsible for all services (see Fee and Insurance Form).

Online Commerce

Certain sections of the "Client Portal" may allow you to pay for services with a credit card. If you make a payment through our "Client Portal", all information obtained during your purchase or transaction, as well as the information you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be collected by the "Client Portal" and our payment processing company.

In our office we use Square for payment processing and have a signed HIPAA compliant Business Associate Agreement (BAA) with that entity.  However, through the portal we use CardPoint credit card processing.  Sacred Wandering has no responsibility and holds no liability for the independent policies of either payment processing company.  In addition, when you make certain payments through our "Client Portal", you may be subject to the additional terms and conditions of a payment processing company.

You release us, our affiliates, our payment processing company, and Merchants from any damages that you incur, and agree not to assert any claims against us or them, arising from your purchase through or use of our "Client Portal" or its Content.

Termination of Use

You agree that we may, at our discretion, suspend or terminate your access to all or part of our "Client Portal" with or without notice and for any reason, including, without limitation, discharge from services and/or breach of this User Agreement. Any suspected illegal, fraudulent, or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Your records will then be secured for 7 (seven) years and will be provided to other medical providers as requested.

Governing Law

This "Client Portal" is controlled by http://counsol.com located at 6735 Conroy Road, Suite 333, Orlando, FL 32835-3566. By accessing this "Client Portal", you agree to be held to their Terms and Conditions.

Any action to enforce this User Agreement shall be brought in the federal or state courts located in Ozaukee County Wisconsin, USA. You hereby agree to personal jurisdiction by such courts and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
